Terms of Service

These Terms of Service ("Terms") govern your access to and use of Peakfai ("the Service," "the Platform"), operated by Inqodo ("we," "us," or "our"). By registering for, accessing, or using the Service, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms.

If you are using Peakfai on behalf of a business or organisation, you represent that you have the authority to bind that organisation to these Terms.

Peakfai is an AI-powered SEO and content marketing platform that enables users to:

• Research keywords and discover content opportunities
• Generate AI-written blog posts optimised for search engines
• Automatically publish content to connected WordPress websites
• Create and schedule social media posts for LinkedIn and X (Twitter)
• Track keyword rankings via Google Search Console integration
• Monitor AI visibility (AEO) across ChatGPT, Perplexity, and Gemini
• Analyse Reddit threads for topic research and engagement
• Access an AI assistant for SEO strategy guidance

The Service is provided on a subscription basis. Features available to you depend on your selected plan.

To use Peakfai, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Keep your password secure and confidential
• Not share your account with others
• Notify us immediately at support@peakfai.com if you suspect unauthorised access

You are responsible for all activity that occurs under your account. We are not liable for losses resulting from unauthorised use of your account where you have failed to take reasonable precautions.

Each account is for use by a single individual or entity. You may manage multiple projects (websites) within one account according to your plan limits.

Peakfai operates on a subscription model. Subscriptions are billed monthly or annually as selected. Current pricing is available at peakfai.com/pricing.

Billing: Payments are processed securely. By subscribing, you authorise us to charge your payment method on a recurring basis at the start of each billing period.

Upgrades/Downgrades: You may change your plan at any time. Upgrades take effect immediately; downgrades take effect at the next billing cycle.

Refund Policy: We offer a 7-day refund policy for new subscriptions if you have not used more than 3 blog posts or 5 keyword research queries in that period. Contact us at support@peakfai.com to request a refund. After 7 days, subscription fees are non-refundable except where required by applicable law.

Failed Payments: If payment fails, we will retry up to 3 times over 7 days. If payment continues to fail, your account will be downgraded to the free tier and your data preserved for 30 days.

Plan Expiry: Time-limited plans (where applicable) expire on their stated date. Upon expiry, access reverts to the free tier. Data is preserved.

Taxes: Prices are exclusive of applicable taxes (VAT, GST, etc.) where required by your jurisdiction.

Each plan includes specific monthly quotas (blog posts, keyword searches, AI generations, etc.). These quotas reset on the 1st of each calendar month. Unused quota does not roll over.

You agree not to attempt to circumvent usage limits, scrape the platform, use automated scripts to artificially inflate usage, or abuse the API in ways that degrade service for other users.

We reserve the right to throttle or suspend accounts that place excessive load on our infrastructure beyond reasonable use.

You agree to use Peakfai only for lawful purposes. You must not use the Service to:

• Generate, publish, or distribute content that is illegal, harmful, defamatory, harassing, or violates the rights of others
• Produce spam, mass-scale low-quality content intended to manipulate search rankings in violation of Google's guidelines
• Create content that impersonates individuals, organisations, or brands without authorisation
• Generate content promoting violence, hate speech, or illegal activities
• Publish copyrighted material without appropriate rights
• Attempt to reverse-engineer, decompile, or extract our AI prompts or proprietary systems
• Resell or sublicense access to Peakfai to third parties without authorisation
• Use the platform for any purpose competitive with Peakfai without disclosure

Violation of this policy may result in immediate account suspension without refund.

Peakfai generates content using large language models (LLMs) via OpenRouter and similar providers. You acknowledge that:

• You own the output: Content generated through your Peakfai account using your keywords, brand data, and prompts belongs to you. You may publish, edit, and monetise it freely.
• Review before publishing: While we strive for accuracy, AI-generated content may contain errors, outdated information, or inaccuracies. You are responsible for reviewing content before publishing, particularly for factual claims, legal advice, medical information, or financial guidance.
• No guarantee of originality: AI models may produce similar content for different users. We do not guarantee uniqueness. You should review important content with plagiarism tools before publication.
• Compliance: You are responsible for ensuring AI-generated content complies with applicable laws, Google's webmaster guidelines, and platform policies where you publish it.
• We do not use your content to train AI: Your keywords, blog posts, and website data are not used to train AI models.

Peakfai integrates with third-party services including WordPress, Google Search Console, LinkedIn, X (Twitter), and Reddit. By connecting these services, you:

• Confirm you have the right to connect and authorise those accounts
• Authorise Peakfai to perform actions on your behalf (publishing posts, reading analytics, posting to social media)
• Acknowledge that third-party services have their own terms and privacy policies
• Accept that we are not responsible for changes to third-party APIs that affect Peakfai's functionality

You can disconnect any integration at any time from your Settings page.

Our IP: Peakfai, its design, algorithms, brand, logos, and underlying technology are owned by Inqodo. You may not copy, reproduce, or create derivative works of any part of the platform.

Your IP: You retain all intellectual property rights in your website content, brand information, and any materials you provide to Peakfai. By using the platform, you grant us a limited licence to process your content solely for the purpose of providing the Service.

No SEO guarantees: While Peakfai is designed to improve your search engine rankings and AI visibility, we do not guarantee specific ranking improvements, traffic increases, or revenue results. Search engine algorithms are outside our control.

"As is" service:The Service is provided "as is" and "as available." We do not warrant that the Service will be error-free, uninterrupted, or meet your specific requirements.

Limitation of liability: To the maximum extent permitted by law, Inqodo shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence.

By you: You may cancel your subscription and delete your account at any time from Settings → Plan. Cancellation stops future billing but does not entitle you to a refund of the current period (subject to our 7-day refund policy).

By us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide notice where reasonably practicable.

Effect of termination: Upon account deletion, your data will be permanently deleted within 30 days. Sections of these Terms that by their nature should survive termination (IP, limitation of liability, governing law) will remain in force.

We may modify Peakfai's features, pricing, or these Terms at any time. We will provide at least 14 days' notice of material changes by email and/or in-app notification. Continued use of the Service after changes take effect constitutes acceptance.

If you disagree with a material change to these Terms, you may cancel your subscription before the change takes effect and receive a pro-rata refund for the unused portion.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating any legal proceedings, you agree to first contact us at legal@peakfai.com to resolve the dispute informally. We will respond within 14 days.
